Custom Agricultural Fertilizer Application Agreement

Custom Applicator agrees to spread dry bulk fertilizer (Urea, DAP, MAP, Potash, Sulfur) in strict accordance with Customer’s agronomist-certified soil sample grid prescription map. Spreader rigs utilize sub-inch RTK-GPS auto-guidance and automatic sectional controller shutoffs to maintain target application rates within ± 5% across all field zones.

Pursuant to State Department of Agriculture Nutrient Management Plans (NMP) and USDA NRCS 590 standards, mandatory application setbacks shall be maintained: minimum twenty-five feet (25 ft) from perennial streams, lakes, ponds, sinkholes, and private potable water wells, and fifty feet (50 ft) from classified public water intakes.

Applicator deploys high-flotation terra-tires (ground pressure ≤ 15 PSI) to mitigate subsoil compaction. Application is prohibited on saturated soil with standing water, snow-covered ground (> 1 inch), or frozen soil (> 2 inches depth) where surface nutrient runoff risks violate state clean water bylaws.

Applicator carries $5,000,000 Commercial Agricultural Pollution & Chemical Drift Liability. Spreading operations shall cease immediately if sustained wind speeds exceed fifteen miles per hour (15 MPH) or in the presence of thermal inversions adjacent to sensitive organic crops or residential property boundaries.

Within forty-eight (48) hours of job completion, Applicator shall deliver calibrated scale weight tickets and digital shapefile As-Applied telemetry coverage maps. Services and bulk fertilizer commodities are invoiced per acre and per ton with payment terms of Net 30.
