1. Aggregate Gradation & Cleanliness Specification Warranty
Operator agrees to process, wet-screen, scrub, and classify Customer’s pit-run sand and gravel. Operator warrants that finished products meet ASTM C33 / AASHTO M6 concrete fine aggregate specifications: Sand Equivalent (SE per ASTM D2419) ≥ 80, Material Finer than No. 200 Sieve (ASTM C117 decantation) ≤ 3.0% (for concrete subject to abrasion), and Fineness Modulus (FM) between 2.30 and 3.10.
2. Raw Pit-Run Feedstock Delivery & Ingestion Standards
Customer warrants that unwashed pit-run material delivered to plant feed hoppers is free of oversized boulders (> 12 inches), clay balls (> 4 inches), roots, organic wood debris, and hazardous industrial contaminants. Ingested tonnage is measured on certified truck scales upon plant entry.
3. Settling Ponds, Silt Management & Process Water Recycling
Operator operates closed-loop water treatment clarifiers and multi-stage settling ponds in compliance with State DEQ NPDES General Mining Process Water Discharge permits. Reclaimed clay fines and silt cake remain Operator’s responsibility for settling pond reclamation and embankment grading.
4. MSHA Title 30 CFR Safety & Pit Traffic Rules
All haul trucks and Customer personnel entering the plant site must comply with Mine Safety and Health Administration (MSHA 30 CFR Part 46/56) regulations: high-visibility PPE, hard hats, steel-toe boots, backup alarms, and designated one-way stockpile traffic patterns.
5. Toll Processing Fees, Scale Verification & Payment Terms
Toll washing is invoiced based on gross scale tons ingested. Invoiced sales of washed sand or gravel from Operator’s reserve are billed per ton FOB plant gate. Operator maintains $10,000,000 MSHA Mining Operations and Commercial General Liability coverage. Payment terms are Net 30 days.
