Non-Destructive Vacuum Excavation Terms, Positive Utility Verification & Environmental Slurry Disposal

1. State 811 "Call Before You Dig" Ticket & Tolerance Zone Mandate
Client warrants that an active, valid state 811 One-Call locate ticket has been executed and all underground utility lines (natural gas, high-voltage electric, fiber optic, water, sewer) are marked. Within the statutory 18" to 24" tolerance zone from painted markings, Contractor’s pressurized water and vacuum suction constitute the sole authorized non-destructive excavation method pursuant to state damage prevention statutes.
2. Water Pressure Regulation & Utility Coating Protection
Contractor shall maintain rotating nozzle water jet pressure at or below 3,000 PSI and maximum water temperature below 140°F (in freezing conditions) to prevent thermal or physical damage to protective pipeline coatings, PVC conduits, or fiber optic sheathing.
3. Environmental Slurry Decanting & Certified Disposal Manifest
All hydro-vac mud and wet soil slurry is captured directly inside the truck’s sealed debris body. Contractor offloads exclusively at licensed environmental decant facilities, soil remediation recycling yards, or approved on-site containment cells with complete waste tracking manifests.
4. Minimum Billing Hours, Port-to-Port Travel & Standby Rates
Work is billed on an hourly portal-to-portal basis with a standard four (4) hour minimum. In the event of jobsite delays due to unmarked utilities, permit hold-ups, or lack of water access, standby time is billed at the standard hourly equipment rate.
5. Commercial General Liability & Underground Utility Endorsement
Contractor maintains $5,000,000 Commercial General & Pollution Liability insurance with dedicated Underground Utility Explosion, Collapse, and Underground (XCU) damage coverage naming Client as Additional Insured.
