Hazardous Secondary Material Toll Distillation Agreement

Recycler agrees to receive, transport, and vacuum distill Customer’s spent industrial solvents (IPA, Acetone, MEK, Xylene, Toluene) in strict compliance with EPA RCRA 40 CFR § 261.4(a)(24) and legitimate recycling requirements under 40 CFR § 260.43. Spent solvents managed under closed-loop reclamation are excluded from the statutory definition of solid and hazardous waste.

Recycler warrants that all distilled reclaimed solvent returned to Customer shall achieve a minimum chemical purity of 99.0% by Gas Chromatography (GC-FID) and Karl Fischer moisture content ≤ 0.10% by weight, meeting ASTM technical grade specifications for direct reuse in precision manufacturing, printing, and coatings operations.

All solvent transfers occur exclusively via dedicated 330-gallon stainless steel IBC totes or UN 1A1 tight-head drums equipped with dry-disconnect vapor recovery couplings. Customer warrants that incoming feedstreams contain no polychlorinated biphenyls (PCBs), heavy metals, or reactive cyanides.

Non-distillable concentrated distillation residues (still bottoms, resin sludge, pigments) representing approximately 4% to 8% of batch volume are profiled, manifested, and transported by Recycler to an EPA-permitted Part B Treatment, Storage, and Disposal Facility (TSDF) for high-temperature thermal destruction.

Services are invoiced based on actual incoming gross volume at the agreed per-gallon toll distillation rate. Recycler maintains $5,000,000 Environmental Impairment & Pollution Liability insurance and provides mass-balance yield reconciliation certificates with every batch delivery. Terms are Net 30.
